These Terms of Service ("Terms") are a legal agreement between you and Construct LLC ("Construct," "we," "us," or "our") and govern your use of the Construct mobile application and our website (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or legal guardian who agrees to these Terms.
2. The Service
Construct is a cognitive-training and educational product that provides interactive courses, brain-training games, progress tracking, and related features. We may add, change, or remove features at any time to improve the Service.
3. Your account
You are responsible for the accuracy of your account information and for keeping your login credentials secure. You are responsible for all activity under your account. Notify us promptly at support@construct.app if you suspect unauthorized use.
4. License and acceptable use
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use, subject to these Terms.
You agree not to:
copy, modify, distribute, sell, or lease any part of the Service;
reverse-engineer or attempt to extract the source code of the Service, except where permitted by law;
use the Service for any unlawful purpose or in violation of these Terms;
interfere with or disrupt the integrity or performance of the Service;
access the Service through automated means or attempt to gain unauthorized access to our systems.
5. Subscriptions, billing, and cancellation
Some features of the Service require a paid subscription ("Premium").
Billing through Apple. Subscriptions and in-app purchases are sold and processed through your Apple App Store account, subject to Apple's terms.
Auto-renewal. Subscriptions renew automatically at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Free trials. If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
Managing and cancelling. You can manage or cancel your subscription anytime in your Apple account settings: Settings → your name → Subscriptions on your device. Deleting the app does not cancel your subscription.
Refunds. Purchases are handled by Apple, and refund requests are subject to Apple's policies. We do not separately process App Store payments or refunds.
Price changes. We may change subscription prices; changes apply to future billing periods and, where required, only after notice to you.
6. Intellectual property
The Service and all of its content, including courses, games, text, graphics, logos, software, and design, are owned by Construct LLC or its licensors and are protected by intellectual-property laws. The "Construct" name and logo are trademarks of Construct LLC. Nothing in these Terms grants you any right to use them without our prior written permission.
7. No medical or professional advice
Construct is a general wellness, educational, and self-improvement product. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or condition. The Service does not provide medical, psychological, or other professional advice, and individual results vary. Always seek the advice of a qualified professional for any questions about a medical or mental-health condition.
8. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that any specific results will be achieved.
9. Limitation of liability
To the maximum extent permitted by law, Construct LLC and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 50.
10. Indemnification
You agree to indemnify and hold harmless Construct LLC from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms.
11. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
12. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. You agree that any dispute not resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, to the extent permitted by applicable law. Before filing any claim, you agree to first contact us at support@construct.app so we can try to resolve it informally.
13. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date. Your continued use of the Service after changes take effect means you accept the revised Terms.
