Construct LLC ("Construct," "we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect, how we use it, and the choices you have when you use the Construct mobile application and our website (together, the "Service").
By using the Service, you agree to the practices described in this Policy.
1. Information we collect
Information you provide to us
Account details — such as your name, email address, and password when you create an account.
Profile and goals — information you give us during onboarding, such as your training goals and self-reported preferences, used to personalize your experience.
Support communications — the contents of messages you send us when you contact support.
Information we collect automatically
Usage and progress data — lessons completed, games played, scores, streaks, XP, and your cognitive score, used to power your training and show your progress over time.
Device and technical data — device model, operating system and version, app version, language, time zone, and general (non-precise) region.
Diagnostics and analytics — app performance, crash data, and aggregate usage patterns that help us improve the Service.
Purchase information
Subscriptions and in-app purchases are processed by Apple through your App Store account. We receive confirmation of your purchase and your subscription status. We do not receive or store your full payment card number.
We do not knowingly collect special categories of data (such as health, biometric, or medical-record data). The Service is a general wellness and educational product, not a medical product.
2. How we use your information
We use your information to:
provide, maintain, and personalize the Service and your training experience;
track your progress, scores, streaks, and assessments;
process and manage your subscription;
respond to your support requests;
improve our courses, games, and features through analytics;
send you service-related messages and, where permitted, optional product updates (you can opt out anytime);
detect, prevent, and address fraud, abuse, or technical issues;
comply with our legal obligations.
3. Legal bases for processing (for users in the EEA/UK)
Where applicable, we process your information on the basis of: performance of our contract with you (to provide the Service); your consent (for optional marketing and certain analytics); our legitimate interests (to improve and secure the Service); and compliance with legal obligations.
4. How we share information
We do not sell your personal information. We share it only:
with service providers who process data on our behalf (for example, cloud hosting, analytics, and customer-support tools) under confidentiality and data-protection obligations;
with Apple, to process purchases and manage subscriptions;
to comply with the law, enforce our Terms, or protect the rights, safety, and property of Construct, our users, or others;
in connection with a business transfer such as a merger, acquisition, or sale of assets, in which case we will notify you of any change in how your data is handled.
5. Analytics and tracking
We use analytics tools to understand how the Service is used and to improve it. Depending on your device settings and applicable App Tracking Transparency permissions, some data may be collected to measure performance. You can control tracking permissions in your device settings at any time.
6. Data retention
We keep your information for as long as your account is active or as needed to provide the Service. When you delete your account, we delete or anonymize your personal information within a reasonable period, except where we are required to retain it for legal, accounting, or security purposes.
7. Your rights and choices
Depending on where you live, you may have the right to access, correct, delete, port, or restrict the processing of your personal information, and to object to certain processing or withdraw consent. Residents of the EEA/UK (GDPR) and California (CCPA/CPRA) have specific rights, including the right to know what we collect and the right that we do not sell personal information (we don't).
To exercise any of these rights, email us at support@construct.app. We will respond as required by applicable law. You may also delete your account at any time from within the app.
8. Children's privacy
The Service is not directed to children under 13 (or the minimum age required in your country), and we do not knowingly collect personal information from them. If you believe a child has provided us with personal information, contact us at support@construct.app and we will delete it.
9. International data transfers
We are based in the United States, and your information may be processed in the United States or other countries that may have different data-protection laws than your own. Where required, we use appropriate safeguards for these transfers.
10. Security
We use reasonable technical and organizational measures designed to protect your information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
11. Third-party links
The Service may link to third-party websites or services we do not control. This Policy does not apply to those third parties, and we encourage you to review their privacy policies.
12. Changes to this Policy
We may update this Policy from time to time. We will post the updated version here and revise the "Last updated" date above. Material changes will be communicated as required by law.
